Declaration of Brazilian Capital Abroad – CBE

You have assets, rights, deposits, properties, shares in companies, shares, commercial credits, etc. outside of Brazil? Well, be aware that you need to fill out a declaration that informs the ownership of these assets, the CBE – Capitals Brasileiros no Exterior.

The CBE Declaration is mandatory and must be completed annually or quarterly, depending on the framework.

Who should do it?
All Brazilian individuals or legal entities that have capital abroad worth US$1,000.00 or more on December 31 of each base year must complete the declaration – Annual CBE, in accordance with CMN Resolution 4,841, dated 7/30. /2020.

Declaration types
There are two types of declarations, which differ in terms of frequency and limit of values ​​(assets in currency and/or goods and rights) for mandatory declaration, see below.

Annual Declaration – individuals or legal entities whose assets abroad exceed US$1,000.00 (one million United States dollars); It is
Quarterly Declaration – individuals or legal entities whose assets abroad exceed US$100,000.00 (one hundred million United States dollars).
What is my deadline?
Annual declaration referring to the base date of December 31st: may be submitted between February 15th and 6pm on April 5th of the following year;
Quarterly statement referring to the base date of March 31st: can be submitted between April 30th and 6pm on the following June 5th;
Quarterly statement referring to the base date of June 30th: can be submitted between July 31st and 6pm on the following September 5th;
Quarterly statement referring to the base date of September 30th: can be submitted between October 31st and 6pm on the following December 5th;
Important warning!
If a declaration is mandatory, the CBE system is available on the Central Bank page (bcb.gov.br), section “Financial stability”, options “Foreign exchange and international capital” > “International capital” > “Brazilian capital abroad (CBE) )”.

In addition to the link to access the system, the page allows access to the “declarant’s manual”, with emphasis on the news about the CBE base year 2020, and the “questions and answers”.

Failure to deliver this additional obligation is subject to a fine, which varies from R$2,500.00 to R$250,000.00.
